END USER LICENSE AGREEMENT (EULA)
This End User License Agreement (“Agreement”) is a legal contract between you (“User” or “Licensee”) and Laptop Logbook – Drivers Daily Log (“Licensor”) regarding your use of the Drivers Daily Log software (“Software”). By installing, copying, accessing, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.
1. License grant
Laptop Logbook – Drivers Daily Log grants User a limited, non-exclusive, non-transferable license to install and use the Software solely for personal or internal business recordkeeping purposes.
2. Restrictions
User may not: (a) modify, translate, adapt, reverse engineer, decompile, or disassemble the Software except as expressly permitted by law; (b) rent, lease, sublicense, sell, distribute, or otherwise transfer the Software to any third party; (c) remove or alter any proprietary notices; (d) use the Software to violate any law or regulation, including U.S. Department of Transportation (DOT) and Federal Motor Carrier Safety Administration (FMCSA) rules.
3. Ownership
The Software is licensed, not sold. Laptop Logbook – Drivers Daily Log retains all right, title, and interest in and to the Software and all associated intellectual property rights.
4. Limited warranty; disclaimer
The Software is provided “AS IS” and “AS AVAILABLE.” Laptop Logbook – Drivers Daily Log warrants only that, under normal use, the Software will substantially perform the basic functions described in any accompanying documentation. Laptop Logbook – Drivers Daily Log disclaims all other warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
5. Data accuracy & user responsibility
Laptop Logbook – Drivers Daily Log does not warrant the accuracy, completeness, or reliability of any statistics, reports, logs, or data generated by the Software. User is solely responsible for the accuracy and integrity of data entered into or produced by the Software and for verifying such data before relying upon it.
6. Compliance & misuse
Laptop Logbook – Drivers Daily Log shall not be liable for any penalties, fines, legal actions, citations, out-of-service orders, or damages arising from inaccurate, falsified, manipulated, or incomplete entries, whether due to User error, intentional alteration, or otherwise. The Software is not an FMCSA-certified ELD.
7. Limitation of liability
To the maximum extent permitted by law, Laptop Logbook – Drivers Daily Log shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including loss of profits, revenue, data, goodwill, business interruption, or substitute goods/services) arising out of or relating to this Agreement or use of the Software, even if advised of the possibility of such damages. Laptop Logbook – Drivers Daily Log’s total cumulative liability for direct damages shall not exceed the amount paid (if any) by User for the Software.
8. Updates & support
Laptop Logbook – Drivers Daily Log may provide updates or patches at its discretion. Any such updates are deemed part of the Software and subject to this Agreement. Unless separately agreed, Laptop Logbook – Drivers Daily Log has no obligation to provide support or maintenance.
9. Term & termination
This Agreement is effective until terminated. Laptop Logbook – Drivers Daily Log may terminate immediately if User fails to comply with any term herein. Upon termination, User must cease all use and destroy all copies. Sections intended to survive (including 3–7, 9–11) shall survive termination.
10. Governing law & venue
This Agreement is governed by the laws of the State of Wyoming, without regard to conflict of laws principles. Exclusive venue and jurisdiction shall lie in the state or federal courts located in Lincoln County, Wyoming, and User consents to personal jurisdiction therein.
11. Entire agreement; severability
This Agreement constitutes the entire agreement between the parties regarding the Software and supersedes all prior or contemporaneous understandings. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
